NADRA’s Obligation in Issuing CNIC to Transgender People

In August 2023, the National Commission for Human Rights addressed the Director General of NADRA regarding the authority’s refusal to register transgender people with the “X” gender marker, following instructions issued in the wake of a Federal Shariat Court judgment. The NCHR letter detailed that the FSC judgment remained ineffective under Article 203D of the Constitution, as appeals were pending before the Supreme Court. The Commission emphasized that denying CNICs to transgender individuals violated fundamental rights, including dignity, equality, freedom of movement, and the right to vote, and called for the immediate reversal of the policy.
