ISLAMABAD, Friday, June 23, 2023: The National Commission for Human Rights (NCHR) has issued a detailed report of jail visits conducted by NCHR team across the country, to investigate allegations of torture and sexual abuse of prisoners in connection with May 9 protest. Jails visited included; Central Jails Karachi, Peshawar, Lahore, Rawalpindi, Quetta and jails of  Nowshera, Swat and Sheikhupura.

The visit was aimed at investigating the authenticity of these allegations, to gauge the conditions of confinement, whether such prisoners had been tortured or not, and to check on the medical records of the prisoners – whether they were screened for illnesses or denied any of their rights and privileges as per law.

The NCHR team comprised of NCHR team and members of civil society including of Justice Project Pakistan and Human Rights Commission of Pakistan (HRCP).

The report mentions that during investigations, the NCHR team received no reports of torture or sexual abuse of any male or female prisoner in either police or judicial custody. The prisoners reported late night arrests and use of disproportionate force at the time of arrest intended to intimidate and cause fear. Several prisoners reported breakages in their homes, confiscation of laptops and verbal harassment. The report says that majority of political prisoners were not aware of their rights in the jail as per jail rules (Rule 64 PPR) and were not informed about the grounds of arrest.

On May 9, 2023 protests were carried out in the wake of the arrest of the Chairperson of Pakistan Tehreek-e-Insaf (PTI). Later on, the media reported incidents of violence and arson by the protesters in which private and public properties were targeted. Apart from attacks on civil government infrastructure and properties, some protesters entered high-security areas including army and air force installations where acts of violence were committed.

During, and after these protests, the provincial authorities initiated widespread arrests in different cities. A larger number of people were detained, and later on, charged under various statutory provisions. Subsequent to the arrests, a number of social media statements and allegations appeared regarding torture, including sexual abuse, of PTI female protesters during arrest and incarceration in the various jails of Pakistan.

In view of growing concerns, the Commission approached government authorities to ensure due process of law by issuing official communication to the various government stakeholders on May 10, 2023. Since no direct complaint was received by the Commission nor was forwarded by any government complaint mechanisms, therefore, a formal investigation was initiated under Sec 9 (C) of the NCHR Act 2012 which empowers it to “visit any jail, place of detention or any other institution where convicts, under trial prisoners, detainees or other persons are lodged or detained.”

At the time of the visit, 28 female under-trial prisoners and 1322 male under-trial prisoners were confined in jails across Punjab. NCHR team met and personally interviewed all women present in the jails at the time of their visit. In Central Jail Peshawar, the Committee was told that 68 citizens had been charged under Section 3 of the Maintenance and Public Order Ordinance, 1960 (3 MPO) due to the activities of 9th May 2023, out of which 48 have been released. Of the 20 remaining prisoners at Peshawar, 13 were juveniles. No female was arrested in Peshawar. There were 33 male but no female PTI protesters detained at Central Jail Quetta. In Central Jail Karachi, the 2 females arrested after the May 9th protests were initially shifted to Sukkur jail and have now been released. Majority of protesters incarcerated in Lahore had provision of legal aid however the 300+ male protesters housed in Central Jail Rawalpindi had no recourse to legal aid or sureties. Majority of juveniles in Peshawar also had no legal aid or counsel.

Although the prisoners did not make any statement alleging torture or sexual abuse, the Commission has expressed concerns over lapses in upholding safeguards as to arrest, gaps in procedures relating to prison standards especially those that are prescribed by law or fundamental rights given under the Constitution of Pakistan and international guidelines. These gaps include delay in the process of Identification parades, lack of information on prisoner’s rights and details on the sections under which they have been booked. The Commission calls upon the government to take immediate remedial action; Information on rights; identification parade; medical screening of prisoners; and establishment of oversight and complaint mechanisms.

پریس ریلیز (اسلام آباد) قومی کمیشن برائے انسانی حقوق (این سی ایچ آر) نے 9 مئی کے احتجاج کے سلسلے میں قیدیوں پر تشدد اور جنسی زیادتی کے الزامات کی تحقیقات کے لیے این سی ایچ آر کی ٹیم کی طرف سے ملک بھر میں کیے گئے جیلوں کے دوروں کی تفصیلی رپورٹ جاری کر دی  گئی ہے۔ الزمات کی تحقیق   کیلئے سینٹرل جیل کراچی، پشاور، لاہور، راولپنڈی، کوئٹہ ، نوشہرہ، سوات اور شیخوپورہ  جیل کا دورہ کیا گیا ۔

ان  دوروں  کا مقصد  الزامات کی صداقت ، قید کی شرائط ، قیدیوں کو تشدد کا نشانہ بنانے اور قیدیوں کے میڈیکل ریکارڈ ،  قید سے قبل میڈیکل اسکریننگ ہونے یا نہ ہونے وغیرہ کی  جانچ پڑتال کرنا  اور قانون کے مطابق  قیدیوں کو ملنے والی حقوق و مراعات  کے بارے میں جاننا تھا ۔

اِن دُوروں میں این سی ایچ آر  کی ٹیم  کے علاوہ  سول سوسائٹی ،جسٹس پروجیکٹ پاکستان اور ہیومن رائٹس کمیشن آف پاکستان (HRCP) کے اراکین بھی  شامل تھے۔

رپورٹ میں بتایا گیا ہے کہ تحقیقات کے دوران  این سی ایچ آر ٹیم کو پولیس یا عدالتی حراست میں کسی بھی مرد یا خاتون قیدی پر تشدد یا جنسی زیادتی کی کوئی رپورٹ موصول نہیں ہوئی۔  جبکہ قیدیوں نے رات گئے گرفتاریوں اور گرفتاری کے وقت غیر متناسب الفاظ کے  استعمال کے بارے میں بتا یا  ۔ کئی قیدیوں نے اپنے گھروں میں توڑ پھوڑ، لیپ ٹاپ ضبط کرنے اور ڈرانے دھمکانے  کی شکایت کی ۔  مزید براں ، رپورٹ میں یہ بھی کہا گیا ہے کہ  سیاسی قیدیوں کی اکثریت جیل قوانین (رول 64 پی پی آر) کے مطابق جیل میں اپنے حقوق سے آگاہ نہیں تھی اور وہ  گرفتاری کی وجوہات سے بھی لاعلم تھی ۔

9 مئی 2023 کو پاکستان تحریک انصاف (پی ٹی آئی) کی چیئرپرسن کی گرفتاری کے تناظر میں احتجاج کیا گیا۔ جس کے بعد میڈیا نے مظاہرین کی طرف سے تشدد اور آتش زنی کے واقعات ، نجی اور سرکاری املاک کو نشانہ بنانے کی اطلاعات دیں ۔اس احتجاج کے دوران   کچھ مظاہرین پاک فوج اورپاک  فضائیہ کی تنصیبات سمیت ہائی سکیورٹی والے علاقوں میں داخل ہوئے اور پُر تشدد کارروائیاں  کیں ۔

مظاہروں کے دوران اور بعد میں صوبائی حکام نے مختلف شہروں میں بڑے پیمانے پر گرفتاریاں کا آغاز کیا ۔ لوگوں کی ایک بڑی تعداد کو حراست میں  لینے کے بعد میں مختلف قانونی دفعات کے تحت چارج کیا گیا۔واضح رہے  گرفتاریوں کے بعد پاکستان کی مختلف جیلوں میں رکھے گئے  قیدیوں اور   پی ٹی آئی  کے مظاہروں میں شامل خواتین پر جنسی زیادتی سمیت تشدد کے حوالے سے سوشل میڈیا پر متعدد بیانات اور الزامات سامنے آئے۔

بڑھتے ہوئے خدشات کے پیش نظرکمیشن نے 10 مئی 2023 کو مختلف سرکاری اسٹیک ہولڈرز سے  باضابطہ رابطہ کرکے  ان تمام تر کارروائیوں کو قانون کے مطابق  کرنے کی درخواست کی  ۔ چونکہ کمیشن کو کوئی براہ راست شکایت موصول نہیں ہوئی تھی  اور نہ ہی سرکاری سطح پر  شکایات کا  اندارج  کیا گیا تھا۔ لہذا این سی ایچ آرنے ایکٹ 2012 کے سیکشن 9(c) کے تحت تحقیقات کا آغاز کیا گیا جو اسے کسی بھی جیل، حراست کی جگہ یا کسی دوسرے ادارے کا دورہ کرنے کا اختیار دیتا ہے جہاں مجرم، زیر سماعت قیدی، زیر حراست افراد یا دیگر افراد کو رکھا گیا ہو ۔

دورے کے وقت پنجاب بھر کی جیلوں میں 28 خواتین اور 1322 مرد ز بطورز یر سماعت قیدی بند تھے۔ این سی ایچ آر کی ٹیم نے دورے کے وقت جیلوں میں موجود تمام خواتین سے ملاقات کی اور ان سے ذاتی طور پر انٹرویو کیا۔ سینٹرل جیل پشاور میں کمیٹی کو بتایا گیا کہ 9 مئی 2023 کی سرگرمیوں کی وجہ سے مینٹیننس اینڈ پبلک آرڈر آرڈیننس 1960 (3 ایم پی او) کے سیکشن 3 کے تحت 68 شہریوں پر فرد جرم عائد کی گئی تھی جن میں سے 48 کو رہا کر دیا گیا ہے۔ پشاور میں باقی 20 قیدیوں میں سے 13 نابالغ تھے۔ پشاور میں کسی خاتون کو گرفتار نہیں کیا گیا جبکہ سینٹرل جیل کوئٹہ میں 33 مرد تھے لیکن کسی خاتون کو حراست میں نہیں لیا گیا۔ سینٹرل جیل کراچی میں 9 مئی کے احتجاج کے بعد گرفتار ہونے والی 2 خواتین کو ابتدائی طور پر سکھر جیل منتقل کیا گیا تھا جنہیں اب رہا کر دیا گیا ہے ۔ لاہور میں قید مظاہرین کی اکثریت کو قانونی مدد حاصل تھی تاہم سینٹرل جیل راولپنڈی میں قید 300 سے زائد مرد مظاہرین کے پاس قانونی مدد یا ضمانت کا کوئی سہارا نہیں تھا۔ پشاور میں نوعمروں کی اکثریت کو  قانونی مدد یا  قانونی مشیر فراہم نہیں کیا گیا ۔

اگرچہ قیدیوں نے  کمیشن کے سامنے تشدد یا جنسی استحصال کا الزام لگاتے ہوئے کوئی بیان نہیں دیا تاہم کمیشن نے گرفتاری کے دوران  ہونے والی کوتاہیوں، جیل کے معیارات سے متعلق طریقہ کار میں خامیوں، خاص طور پر قانون یا آئین کے تحت دیئے گئے بنیادی حقوق   نہ دینے پر تشویش کا اظہار کیا ہے۔  ان   تحفظات میں شناختی پریڈ کے عمل میں تاخیر، قیدیوں کے حقوق کے بارے میں معلومات کی کمی اورجن  سیکشنز کے تحت قیدیوں  پر مقدمہ درج کیا گیا  اس کے بارے میں قیدیوں کو آگاہ  نہ کرنا  شامل ہے۔ کمیشن حکومت سے مطالبہ کرتا ہے کہ وہ فوری کارروائی عمل میں لائے  قیدیوں کے  حقوق کے بارے میں معلومات،شناختی پریڈ،قیدیوں کی طبی جانچ   ، ان کی  نگرانی اور شکایت کے اندارج کا طریقہ  کو بہتر بنائے ۔
